We at Perceptive Things know you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our privacy practices that govern your use of our website located at http://www.perceptivethings.com (the “Site”), mobile application (“App”), and/or online dashboard made available at the Site via login for viewing and analyzing Sensor Data (as defined herein) for use in conjunction with hardware products, services, IoT plug-ins and other software (the “Services”). By using or accessing the Site and/or Services in any manner, you acknowledge that you accept the terms outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways.

Your use of Perceptive Things' Services is at all times subject to the Terms of Use, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use.

Personal Information

This Privacy Policy covers our treatment of personally identifiable information, such as name, address, email address or phone number ("Personal Information") that we gather when you are accessing or using our Site and/or Services, but not to the practices of companies we don't own or control, or people that we don't manage. We use this Personal Information to: provide basic functionality of our Site and/or Services, personalize and improve our Services, allow you to set up an Account and profile.

We do not knowingly collect or solicit Personal Information from anyone under the age of 13. If you are under 13, please do not attempt to use the Site and/or Services or send us any of your Personal Information. If we learn that we have collected Personal Information from a child under age 13, we will respond as described in our Terms of Use, including deleting your Personal Information. Information You Give Us

We receive and store Personal Information you knowingly provide to us through creating an Account.  This Personal Information can include, without limitation, your name, email address, shipping address, billing address, phone number, credit card details, location name, location, group and device names, device location names, device or group images, and third-party account credentials. If you provide your third-party account credentials to us, you understand some content and/or information in those accounts ("Third Party Account Information") may be transmitted into your Account with us if you authorize such transmissions, and that Third-Party Account Information transmitted to our Site and/or Services is covered by this Privacy Policy.

If you have provided us with your contact information, we may use such information to communicate with you. For example, we may send you updates about our services, informational updates, surveys or promotional offers (either on our own behalf, or on behalf of other businesses), or communicate with you about your use of the Services. Also, we may receive a confirmation when you open a link in an email you receive. Please note that you may not be able to opt out of certain message from us. This confirmation helps us make our communications with you more useful and improve our services. If at any time you decide you do not want to receive promotional communications from us, you can indicate your preference by clicking 'unsubscribe from this list' or 'update subscription preferences' service-level communications that we deem critical to your use of the Services.

Certain user profile information, including without limitation a user’s name, location, and any content that such user has uploaded to the Services, may be displayed to other users to facilitate user interaction within the Site and/or Services or address your request for Perceptive Things’ Services. Your Account privacy settings may allow you to limit the other users who can see the Personal Information in your user profile and/or what information in your user profile is visible to others. Any content you upload to your public user profile, along with any Personal Information or content that you voluntarily disclose online in a manner other users can view (on discussion boards, in messages and chat areas, etc.) becomes publicly available, and can be collected and used by others. Your user name may also be displayed to other users if and when you send messages or comments or upload content through the Services and other users can contact you through messages and comments.

 

Automatic Information

Whenever you interact with our Site and/or Services (whether via a mobile application, our IoT plug-in, browser, or other application, connecting a physical device to our Services, connecting a third-party service to our Site and/or Services, or otherwise), we automatically receive and record information on our servers, logs and databases from your browser, application, services or device(s). Our Services are designed to allow you to connect various physical devices such as the Perceptive Things sensors and LoRaWAN gateway, and associated Perceptive Things and third-party sensors and other devices) to the Services. While connected to the Services, these devices automatically report Sensor Data and other information to our servers (including information that you may have provided when setting up or configuring that device), which may include Personal Information. For example, if you connect a water leak sensor to the Services, the information from that sensor will be transmitted to the Services, along with any identifying information that you have chosen to associate with that sensor (e.g., the device name, group name, and location name that you have assigned to the sensor within the Services). The type of information that is collected from each device will vary depending on the device type.

Other information collected automatically through the foregoing means may include your IP address, location details, "cookie" information, mobile device, operating system, the type of browser, demographic information, application and/or device(s) you're using to access our Site and/or Services, click-through paths, the identity of the page or feature you are requesting or interacting with, time on page of feature, and other indicators of how you are interacting with the Services. "Cookies" are identifiers we transfer to your device that allow us to recognize your browser, application or device and tell us how and when various pages and features in our Site and/or Services are visited or used and by how many people. You may be able to change the preferences on your browser, application or device to prevent or limit your device's acceptance of cookies, but this may prevent you from taking advantage of some of our features. In addition, our third-party partners, including advertising partners (discussed below), may also use web beacons, or transmit cookies to and read cookies from your browser, application or device when you visit or use our Site and/or Services (including, without limitation, to collect information in connection with the Google Trusted Stores program or Google Demographics and Interests). A third party may also transmit cookies to you if you click on a third-party website.  In these instances, our Privacy Policy does not apply to the use of cookies by third parties.  We may also deliver a file to you through the Site and/or Services (known as a "web beacon") from an ad network. Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites. Because your web browser must request these advertisements and web beacons from the ad network's servers, these companies can view, edit, or set their own cookies, just as if you had requested a web page from their site.

How We Use Your Personal Information

We may rely on your consent to use your data for certain direct marketing purposes. You can withdraw your consent anytime by contacting us or change your settings in your Account as described below.

In certain instances we may need to use your Personal Information to handle and resolve legal disputes, for regulatory investigations and compliance or to enforce the Terms or Privacy Policy.

We also use third-party analytics tools to help us measure traffic and usage trends for the Sites. These tools collect information sent by your device or our Sites, including the web pages you visit, add-ons, and other information that assists us in improving the Sites. We collect and use this analytics information with analytics information from other users so that it cannot reasonably be used to identify any particular individual user.

We may employ other companies and people to perform tasks on our behalf and need to share your information with them to provide our Site and/or Services to you. However, these companies or people do not have any right to use the Personal Information we share with them beyond what is necessary to assist us as identified in this Privacy Policy.

Finally, we never use or share the Personal Information provided to us online in ways unrelated to the ones described in this Privacy Policy without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.

Aggregated Information 

We may anonymize your Personal Information so that you cannot be individually identified, and provide that information to our partners or use that information for marketing or promotional items (“Aggregate Information”). Sensor Data that we collect is also Aggregate Information.  We may also provide Aggregate Information to our partners, who may use such information to understand how often and in what ways people use our Services. However, except as described below, we do not disclose Aggregate Information to a partner in a manner that would identify you personally.

Partners, Affiliated Businesses and Third-Party Websites

In certain situations, partners, businesses or third-party websites we're affiliated with ("Affiliated Businesses") may sell items or provide services to you through the Services (either alone or jointly with us), including reselling or providing Perceptive Things devices. You can recognize when an Affiliated Business is associated with such a transaction or service based on the presence of their brand or a transaction you are conducting directly with that Affiliated Business. We will share your Personal Information with that Affiliated Business only to the extent that it is related to such transaction or service, and to the extent that you have explicitly accepted terms with that Affiliated Business and where you authorize us to share your Personal Information. We have no control over the policies and practices of Affiliated Businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an Affiliated Business, please review all such business' or websites' policies. If you decide you no longer want to share Personal Information with an Affiliated Business, you may no longer be entitled to receive certain benefits from the Affiliated Business or have access to the Services without establishing a new account or relationship with Perceptive Things.

Disclosure to Law Enforcement and/or Authorities

We may disclose Personal Information if required by law, for example to law enforcement or other authorities. This includes court orders, subpoenas and orders arising from legal processes, or administrative or criminal investigations. We may also disclose your Personal Information if the disclosure is necessary for the prevention, detection or prosecution of criminal acts or to prevent other damage, or in response to a legal action or to enforce our rights and claims.

Business Transactions

In the event that we enter into a business transaction, such as a merger with or an acquisition by another company, or a sale of some or all of our assets, your Personal Information may be among the assets that are transferred or disclosed in connection with such a transaction.  You will be notified via email of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information.

How We Store and Protect Your Personal Information

Your Account is protected by a password for your privacy and security. If you access your Account via a third-party site or service, you may have additional or different sign-on protections via that third-party site or service. You must prevent unauthorized access to your Account and Personal Information by selecting and protecting your password, PIN number and/or other sign-on mechanism appropriately and limiting access to your computer or device and browser or application by signing off after you have finished accessing your Account.

We endeavor to protect the privacy of your Account and other Personal Information we hold in our records, but we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

The Site and/or Services may contain links to other sites or applications. We are not responsible for the privacy policies and/or practices on other sites. When following a link to another site you should read that site’s privacy policy.

Accessing Personal Information

Through your Account and Site and/or Service settings, you may be able to access and edit or delete the following information you’ve provided to us, which may include:

  • name and password

  • shipping address

  • billing address

  • credit card information

  • email address

  • location, group and device information

  • user profile information

You can always opt not to disclose information to use, but keep in mind some information may be needed to register with us or to take advantage of some of our special features or the Services in any form.

Please note that some information may remain in our records after your deletion in order meet certain business needs and / or comply with retention requirements. of such information from your Account.

Your California Privacy Rights

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to ask us for a notice identifying the categories of Personal Information which we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties.
